The Law of Democratic Governing, 2nd ed. is a follow-up to Volume II of the original version of the book. It first establishes a comprehensive method of examining the workings of democratic government and governance by systematically classifying the institutions and processes of the modern state. It then examines each of the major aspects of democratic governing through the judgments of courts, as well as through other sources such as rulings by the Speaker of the House of Commons and case studies drawn from governmental practice. The book concentrates on Canadian examples. However, it also draws on material from the U.S., the U.K., Commonwealth, and other jurisdictions around the world. This book can serve as a useful companion to The Theory and Practice of Political Law, now also in its 2nd edition. Both books emphasize the importance of the linkages and interactions among public law, public policy and politics, united in the subject matter of political law.


Gregory Tardi, B.A. (Hons), B.C.L., LL.B., DJur., served for a long time as a lawyer in Canada’s Federal Public Service. He worked in various capacities for several government departments including the Privy Council Office and the Department of Justice. In particular, Mr. Tardi was Legal Counsel at Elections Canada and later Senior Legal Counsel in the Office of the Law Clerk and Parliamentary Counsel to the House of Commons in Ottawa. In this latter capacity, he provided advice on a variety of legal issues to Members of the House of Commons, to the Speaker of the House of Commons, to the Board of Internal Economy and to the House Administration. Mr. Tardi has taught at Carleton University, at the Faculty of Law of McGill University and in Osgoode Hall Law School of York University. He has lectured in Canada, the U.S., France and Hungary and has published several books and many articles. He is Executive Editor of the Journal of Parliamentary and Political Law / Revue de droit parlementaire et politique.
